Navigating the Complexities of Dual Agency


I recently had the opportunity to write an article for Inman discussing dual agency and its potential rise in the post-NAR settlement era. As a compliance consultant, I can't help but think of the extensive list of compliance concerns that dual agency brings to the table. Regardless of one's role in the industry, it’s widely recognized that dual agency carries significant risks and, in some states, comes with additional regulatory requirements when the same agent represents both sides of a real estate transaction.


For music enthusiasts like myself, if dual agency were a song, "Tightrope" by Stevie Ray Vaughan and Double Trouble perfectly encapsulates its essence. The lyrics, “Walkin' the tightrope between wrong and right, Walkin' the tightrope both day and night,” resonate with the precarious balance inherent in this agency arrangement.
